Preamble

Dominant Travel (hereinafter referred to as the “Tour Operator”) is a professional tour operator specializing in curated, culturally immersive, and premium travel experiences.

These Terms and Conditions constitute a legally binding agreement between the Tour Operator and any individual booking or participating in a tour (hereinafter referred to as the “Traveler”).

By submitting a deposit, making any payment, signing a Registration Form, or participating in any tour, the Traveler confirms that they have read, understood, and agreed to be legally bound by these Terms and Conditions in their entirety.


1. Contract and Agreement

1.1 Acceptance of Terms

Submission of any payment constitutes full and binding acceptance of this Agreement.

1.2 Entire Agreement

This Agreement supersedes all prior communications, representations, or understandings, whether oral or written.

1.3 Authority and Group Bookings

Any person booking on behalf of others warrants that they have full authority to bind all Travelers and assumes joint and several liability for all obligations and payments.

The Tour Operator shall not be liable for any failure by a group leader or agent to communicate these Terms.

1.4 Accuracy of Information

The Traveler is responsible for ensuring that all personal information provided is accurate. Any additional costs arising from inaccuracies shall be borne solely by the Traveler.


2. Reservations and Payments

2.1 Confirmation Requirements

A reservation is confirmed only upon:
a) Receipt of the required non-refundable deposit; and
b) Receipt of a duly completed Registration Form.

The Tour Operator reserves the right to decline any booking at its sole discretion.

2.2 Deposit

A USD 1,500 non-refundable deposit per person is required unless otherwise specified.

Deposits are non-transferable except where expressly authorized in writing.

2.3 Final Payment

Final payment is due 90 days prior to the tour start date unless otherwise specified.

Failure to remit payment by the due date results in automatic cancellation without notice and forfeiture of payments made.

2.4 Price Adjustments

The Tour Operator reserves the right to adjust pricing due to:

  • Currency fluctuations

  • Fuel surcharges

  • Government-imposed taxes or fees

  • VAT or tourism tax changes

  • Supplier price increases

Any such adjustment shall be reasonable and communicated in writing.


3. Minimum Participation – Conditional Operation

All group tours require a minimum of six (6) confirmed participants.

No departure is guaranteed until written confirmation is issued.

Travelers must not purchase international airfare until written confirmation is received.

The Tour Operator shall not be liable for independently purchased travel arrangements made prior to official confirmation.

If minimum participation is not reached, the Traveler may transfer to another confirmed departure or receive a refund of amounts paid to the Tour Operator.


4. Special Payment Terms – 7-Day Egypt Total Solar Eclipse Tour (August 2027)

Due to substantial advance supplier commitments:

  • 50% of the total tour price is due 1 March 2026 and becomes non-refundable once paid.

  • Final balance is due 1 November 2026 and becomes non-refundable once paid.

All such payments represent agreed liquidated damages reflecting significant pre-paid supplier obligations.


5. Cancellations and Refunds

5.1 Cancellation by Traveler – Standard Tours

All cancellation requests must be submitted in writing.
The effective date is the date written notice is received.

Cancellation charges represent a reasonable estimate of the Tour Operator’s anticipated losses and administrative costs and are agreed as liquidated damages, not as a penalty.

Cancellation schedule:

  • 90 days or more prior to tour start: Refund minus non-refundable deposit

  • 89–60 days prior: 50% of total tour price non-refundable

  • 59–30 days prior: 75% of total tour price non-refundable

  • 29 days or fewer: 100% of total tour price non-refundable

No refunds shall be provided for:

  • Failure to obtain passports, visas, or required documents

  • Visa denial

  • Missed flights or delayed arrival

  • Voluntary withdrawal

  • Illness or personal circumstances

  • Dissatisfaction with the tour

  • Weather conditions or natural events

The Tour Operator has no obligation to resell canceled space and is not required to mitigate losses.

Where mandatory law requires otherwise, such law shall apply only to the minimum extent required.


5.2 Eclipse Tour Cancellation

For the 7-Day Egypt Total Solar Eclipse Tour, all payments become non-refundable once paid, except where mandatory law requires otherwise.


5.3 No Refund for Unused Services

No refunds shall be issued for unused services, voluntary withdrawal, or early departure from the tour.


6. Role of the Tour Operator & Third-Party Suppliers

The Tour Operator acts as organizer and intermediary for independent third-party suppliers, including hotels, airlines, cruise operators, transportation providers, guides, and event operators.

All such suppliers are independent contractors.

The Tour Operator shall not be liable for any act, omission, delay, negligence, insolvency, or default of any third-party supplier.


7. Itinerary Modifications

The Tour Operator reserves the right to make reasonable changes to accommodations, transportation, order of visits, activities, or scheduling.

Such changes shall not constitute breach of contract provided the overall standard and character of the tour remain substantially similar.


8. Assumption of Risk

The Traveler acknowledges that international travel involves inherent risks including, but not limited to:

  • Political instability

  • Health risks

  • Transportation incidents

  • Government regulations

  • Site closures

  • Weather disruptions

  • Desert or river travel risks

  • Astronomical event visibility

Participation constitutes voluntary assumption of these risks.


9. No Guarantee of Natural Conditions

The Tour Operator does not guarantee weather conditions, clear skies, eclipse visibility, wildlife sightings, river levels, or access to specific sites.

No refund or compensation shall be due for unfavorable natural or environmental conditions.


10. Health and Insurance

The Traveler warrants being medically fit to participate.

Comprehensive travel insurance covering medical expenses, evacuation, interruption, and cancellation is strongly recommended.

The Tour Operator is not responsible for medical incidents or related costs.


11. Traveler Conduct

The Tour Operator reserves the right to remove any Traveler whose conduct is disruptive, unsafe, unlawful, or detrimental to the group.

No refund shall be provided.

The Traveler shall bear all resulting costs.


12. Force Majeure

The Tour Operator shall not be liable for delay, modification, or cancellation caused by events beyond its reasonable control, including natural disasters, government actions, pandemics, war, civil unrest, supplier insolvency, or transportation disruption.

Refunds, if any, are limited to recoverable supplier amounts.


13. Limitation of Liability

To the fullest extent permitted by applicable law:

The Tour Operator’s total aggregate liability shall not exceed the total amount paid by the Traveler.

The Tour Operator shall not be liable for indirect, consequential, incidental, special, or punitive damages, emotional distress, loss of enjoyment, or lost profits.

Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability which cannot lawfully be excluded under applicable law.


14. Indemnification

The Traveler agrees to indemnify and hold harmless the Tour Operator from claims arising from:

  • Traveler misconduct

  • Violation of laws

  • Breach of this Agreement

  • Claims by third parties caused by the Traveler


15. Claims Procedure and Time Limitation

Any claim must be submitted in writing within thirty (30) days of tour completion.

Any legal action must be initiated within one (1) year of the tour end date.

Failure to comply constitutes waiver of the claim.


16. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the Arab Republic of Egypt.

Disputes shall be submitted to the competent courts of Egypt.

If mandatory consumer protection laws of the Traveler’s country apply, such laws shall prevail only to the minimum extent required.


17. Severability and Survival

If any provision is found unenforceable, the remaining provisions remain in full force.

All limitation of liability, indemnification, jurisdiction, and time limitation clauses survive termination.


Final Acknowledgment

By submitting payment, the Traveler confirms that they:

  • Have read and understood these Terms and Conditions;

  • Accept the limitation of liability;

  • Accept the cancellation and refund policy;

  • Voluntarily assume travel-related risks;

  • Agree to the governing law and jurisdiction provisions.
